GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 14532 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4 to 6 respondents and their staff in calling the petitioner to the 4th respondent police station, and threatening the petitioner at the behest of 7th respondent to transfer his self-acquired property i.e. the weigh bridge and 2 shops in Ac 0-10 cents of land or 532 sq.yards land in Macherla, Palnadu District to the 7th respondent or risk being implicated in false cases as illegal, arbitrary and violative of Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondent Nos. 4 to 6 and their staff not to interfere in civil disputes, by calling the petitioner to the 4th respondent police station, pressurize or harass to transfer his self-acquired property i.e. weigh bridge and 2 shops in Ac 0-10 cents of land or 532 sq.yards land in Macherla, Palnadu District to the 7th respondent or threaten the petitioners with implication in false cases, while directing the 2nd and 3rd respondents to initiate departmental action against the 5th and 6th respondents for such illegal acts.…” 2. Heard Sri Sasanka Bhuvanagiri, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that the respondent- police are calling the petitioner to the police station at the instance of the unofficial respondent without there being any crime registered against him. He would further submit that the police are interfering in the civil disputes between the petitioner and the unofficial respondent. 4 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaint of the 7th respondent, the petitioner was called to the police station for preliminary enquiry only. No crime has been registered against him. He would further submit that they are not interfering in the civil disputes between the parties. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to call the petitioner to the police station in absence of any crime which is registered against him. The police are further directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
