The applicant ‘Manoj Pradhan’ is in judicial custody in relation to Case Crime No. 311 of 2022 registered on the basis of First Information Report dated 13.01.2021, P.S. Rudrapur, District Udham Singh Nagar, wherein, the present applicant along with other persons were implicated for the offences punishable under Sections 420 and 467 of IPC. During investigation some more panel provisions were added i.e. Sections 468, 471 r/w 120B of IPC. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and he was only a salaried employee in Akansha Automobile and he has no concern with the allegations as alleged. 5. Apart from this, he submits that the main accused Shahid have already been enlarged on bail by this court on 22.09.2023 in Bail Application No. 1310 of 2023. He further submits that in other three cases of the same nature the applicant have also been implicated, however, he was also enlarged on bail in other three cases. 6. Per contra, learned A.G.A. Mr. V.S. Pal submits that the investigation is still going on, however, he has not disputed this fact that the main accused has already been enlarged on bail. Furthermore, he has not disputed this fact that in other three FIRs in which the applicant has been implicated the applicant also enlarged on bail. 7. After hearing the arguments of learned counsel for the parties and further taking into consideration that the main accused has already been enlarged on bail, this court is of the view that the applicant deserves for bail. 8. After hearing the arguments of learned counsel for the parties and without expressing any 2025:UHC:1953 opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Manoj Pradhan’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned subject to the following conditions: (i) The applicant will cooperate with the investigation and will not make any attempt to influence or to give any threat to the witness. (ii) The applicant shall also not in connection with other co-accused in any manner and if he is found to be involved then the prosecution is free to move an application for cancellation of this bail.
