1. The instant bail application has been filed by the applicant Rakesh Kumar Jat S/o Shri Jagdish Prasad Jat, aged about 31 years, arrested by the police on 01.12.2025 in connection with the FIR bearing No.307/2025 dated 21.09.2025 registered at Police Station Vishwakarma, Jaipur in respect of the incident dated 26.02.2025 for the offences punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 329(3) B.N.S. The bail application of the applicant was rejected by the Additional District and Sessions Judge No.2 vide order dated 12.12.2025, thereafter, the applicant has preferred this bail application under Section 483 B.N.S.S.
2.
Learned counsel submits that the applicant was known to the person who entered into the agreement and he simply became the witness to the agreement and he was not aware about the nature of the transaction. In view of the above fact, learned counsel
[2025:RJ-JP:51761] (2 of 2) [CRLMB-16923/2025] submits that the accused-applicant has falsely been implicated in the present case, as he is not a beneficiary to the said agreement, he may be enlarged on bail.
3. Learned Public Prosecutor strongly opposed the bail application and submits that the applicant is involved in three criminal cases of different nature, and therefore, the present applicant may not be enlarged on bail.
4. Considering the overall facts and circumstances of the case, and noticing the fact that the offences are triable by the Magistrate, he simply being a witness to the incident and he is not a beneficiary, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-applicant on bail.
7. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-applicant - Rakesh Kumar Jat S/o Shri Jagdish Prasad Jat shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The applicant is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
