This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.449/2025 registered at Police Station – Masturi, District Bilaspur for the offences punishable under Sections 318 (4), 320, 336, 338 and 61 of Bhartiya Nyaya Sanhita 2023. Case of the prosecution, in brief, is that the present co-accused Branch Manager/In-charge of Paddy Purchase and applicant have committed embezzlement of 1763.77 quintal of paddy from the Paddy Procurement Centre Risda, Registration Number 169 of Sewa Sahkari Samiti Masturi, District-Bilaspur in paddy purchase years of 2024-2025, The applicant is daily wage worker /employee as Data Entry Operator, he is working under the co-accused manager/ in charge of paddy purchase Centre Risda, Registration Number 169 of Sahkari Sewa Samiti Masturi. After long time of the incident the written complaint has been lodged without explanation of inordinate delay on 17-04-2025 against the incharge of paddy purchase Krishna Kumar Kariyare, Therefore the Police Station Masturi has registered the FIR a case as a crime no 449/25 offences punishable under section 318 (4), 320, 336, 338 and 61 of Bhartiya Nyaya Sanhita 2023 against the present applicant & other Co accused person on 14-07-2025. 3. Learned counsel for the applicant submits that submits that the applicant has been falsely implicated in this case and no prima facie case has been made out against him. He would submit that the applicant is daily wage worker/employed as Data Entry Operator, he is working under the co-accused manager/ in charge of paddy purchase centre, Risda. He would submit that other co-accused namely Krishna Kumar Kariyare posted in Sewa Sahkari Samiti Risda as a in-charge of Society and all the work-related security arrangement, administrative amount and income and expenditure of paddy has been done by co- accused and there is no interference by present applicant. He would further submit that main accused Krishna Kumar Kariyare who is in charge of the society has been arrested. He would further submit that 3 the applicant’s work is only to maintain the data of paddy in online register in the computer through token issued by the manager/in charge of paddy purchase centre. He would submit that the applicant has no criminal antecedents, therefore, the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, nature of allegation against the applicant who is a data entry operator and materials available on record, without further commenting anything on merits, this Court finds it appropriate to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Sukh Sagar Jangde, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be 4 prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
