The petitioner is apprehending his arrest in connection with Chandwara PS Case No.80 of 2025, for offence registered under section 274, 275 and 3(5) of BNS, 2023 and section 47(a) of Excise Act, pending in court of learned Judicial Magistrate First Class, Koderma. 3. Learned counsel for petitioner submits that the house in question has been rented out by the petitioner to another person wherefrom foreign liquor has been recovered. He next submits that the petitioner has got no criminal antecedent. 4. Learned State counsel opposes prayer and submits that there is no document to suggest that the said house was rented out to another person by the petitioner and allegation of recovery of foreign liquor is from the house of the petitioner. 2025:JHHC:38580 2 5. In paragraph no.7 the petitioner has stated that he has handed over the said house on rent to another person and the petitioner has got no criminal antecedent, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Koderma, in connection with Chandwara PS Case No.80 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
