THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER Heard the learned counsel appearing for the parties. 2. In this writ petition, the petitioner has sought for direction to respondent No.2 to grant PMR Certificate, as to the description of the property marked in the application and same was rejected by the respondents by the orders produced at Annexure-A, A1 and A2 respectively on the ground that CC No.353 of 2015 is pending consideration before the competent Civil court at Nelamangala. - 3 - HC-KAR NC: 2025:KHC:46230 WP No. 4775 of 2020 3. It is also submitted by the learned counsel for the petitioner that the criminal proceedings is at the fag-end before the competent court and likely to be concluded within three months. 4. Having considered the submissions and on perusal of the records, it is evident that the subject matter of the criminal case relates to the very same property for which the petitioner seeks issuance of the PMR Certificate. In my view, the pendency of the said proceedings, particularly when they are at the fag end, does not create any legal impediment for respondent No.2 to process and issue the PMR Certificate. Therefore, respondent No.2 is directed to consider the petitioner’s request and issue the PMR Certificate within an outer limit of three months from the date of receipt of a certified copy of this order. Accordingly, the writ petition is disposed of. Sd/- (E.S.INDIRESH) JUDGE SB List No.: 1 Sl No.: 4
