This Criminal Miscellaneous Petition is filed seeking cancellation of bail granted to Respondent No. 3 on the ground that Respondent No. 3 while obtaining bail in MCRC No. 3703/2024 under Section 439 CrPC for alleged commission of offence under Section 147, 148, 294, 506B, 323, 324, 307, 302 of IPC and Section 25 & 27 of the Arms Act has not brought to the notice of this Court that the applicant is having one more criminal antecedent against him in connection with crime No. 118/2022 registered for alleged commission of offence under Section 34 of the Chhattisgarh Excise Act. No other ground has been raised. Learned counsel for applicant however places reliance upon PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA
2 / 2 the decision passed by High Court of Allahabad in the case of Mohd. Ishtiyak Khan vs. State of U.P. passed in Cri. Misc. Bail Cancellation Application No. 177 of 2023.
2. Considering the submission of learned counsel for applicant and the grounds raised, I do not find that the said ground to be a good ground to cancel the bail which has already been granted to applicant considering the merits of the case in that crime.
