JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 2 07-05-2025 Heard learned counsel for the petitioners as well as Patna High Court CR. MISC. No.28770 of 2025(2) dt.07-05-2025 2/3 the learned APP for the State. 2. The petitioners apprehend their arrest in connection with Nautan P.S. Case No. 439 of 2024, registered for the offences punishable under Sections 126(2) /115(2) /118 /109 / 76/303(2)/329(4)/351(2)/3(5) of the BNS Act. 3. As per allegation, the accused persons demanded Rs. 5,00,000/- as extortion from the informant. Upon his refusal, they allegedly entered his field, cut down 50 banana plants, and looted articles worth Rs. 50,000/- from his grocery shop. It has further been alleged that Jitan Yadav (petitioner no. 3) assaulted Devraj Prasad with farsa on his head. Co-accused Vivek Yadav assaulted Ajit Prasad with iron rod on his head. Co-accused Ankit Yadav assaulted Lalsa Devi with farsa on his head. Bullet Yadav (petitioner no. 5) inflicted lathi blow and fractured arm of Ankit Kumar. Moti Yadav (petitioner no. 12) dragged Lalsa Devi on the ground and tried to outrage her modesty. 4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case. The members of defense side have also suffered injuries. He has further submitted that all the injuries suffered by the injured persons are simple in nature except one fractured injuries in the Patna High Court CR. MISC. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bettiah, West Champaran in connection with Nautan P.S.
