Writ petition is filed for issuance of writ of mandamus directing respondents to grant CL-7 License to petitioner in respect of Boarding and Lodging run by him in name and style of 'Sri Maruthi Mahal Boarding and Lodging' situated at no.13, Khatha no.50, Bygondanahalli Village, Dasanapura Hobli, Bengaluru North Taluk. - 3 - HC-KAR NC: 2025:KHC:34347 WP No. 25684 of 2025 3. It was submitted petitioner constructed Boarding and Lodging building, in year 2024-25 and filed application for issuance of CL-7 license with respondent no.3 along with all necessary documents and depositing Rs.4,60,000/- towards license fee. It was submitted that petitioner had taken permission from Machohalli Gram Panchayath for construction of building and obtained No Objection Certificate as per Annexures-C, D and E respectively. Petitioner had also obtained Clearance Certificate. Such being case, as petitioner had complied all necessary requirements, respondents were not justified in keeping petitioner's application in cold storage without consideration and therefore, sought for allowing writ petition. 4. Learned Additional Government Advocate on other hand submitted that if petitioner's applications were pending, same would be considered and appropriate orders passed within a reasonable time. 5. From above, it is seen that only relief sought by petitioner is for writ of mandamus directing respondents to - 4 - HC-KAR NC: 2025:KHC:34347 WP No. 25684 of 2025 consider his application for grant of CL-7 license, stated to be pending with respondent no.3. 6. Since filing of application for issuance of CL-7 license by petitioner its pendency with respondent no.3 is not seriously in dispute, instead of retaining writ petition, it would be appropriate to dispose it of directing respondents to consider petitioner's application in accordance with law within time limit. 7. Ordered accordingly. Writ petition is disposed off. Respondent no.3 is directed to consider petitioner's application for issuance of CL-7 license, if still pending, within a period of four weeks from date of receipt of certified copy of this order and inform petitioner result of such consideration.
