JUSTICE PRADEEP SINGH YERUR ORAL ORDER This writ petition is filed by the petitioners seeking a writ of mandamus for a direction to Respondent No.2 to issue clarifications/instructions as to placement of the petitioners, prior to Respondent No.3 promoting from among 129 employees placed above the petitioners. 2. It is the case of petitioners that they were selected as Artisan Grade-III - Mechanics and reported to duty in the respondent-KSRTC/NEKRTC. Upon completion of probationary period, they were transferred to BMTC, which is Respondent No.2. Upon transfer of the employees from the other Corporations to the BMTC, Respondent No.3 issued a status - 4 - HC-KAR NC: 2025:KHC:37146 WP No. 15841 of 2025 letter dated 21.01.2019 showing the names of the transferred employees, in which the names of petitioner Nos.1 to 4 are shown at serial nos.2,4,5 and 8 and petitioner No.5 was transferred subsequently and therefore, his name is not reflected in the said letter. 3. It is further case of the petitioners that pursuant to the directions issued by the Government of Karnataka, Respondent No.2/KSRTC issued a Circular dated 13.1.2023, wherein it is specifically stated that service conditions as applicable to KSRTC would apply to transferred employees in BMTC, NWKRTC and NEKRTC. On 23.5.2024 BMTC granted seniority to the similarly placed employee - Naveen G.N., who was at serial No.1 in the status letter, is placed at Sl.No.84 in the final BMTC seniority list, but the same was denied to the petitioner. 4. It is the contention of learned counsel for petitioners that subsequently, on 2.1.2025, the Respondent/BMTC published a provisional seniority list, wherein all the employees of BMTC appointed subsequent to the petitioners were placed above the names of the petitioners, though petitioners were appointed earlier to them. The petitioners filed objections to - 5 - HC-KAR NC: 2025:KHC:37146 WP No. 15841 of 2025 the said provisional seniority list. Thereafter, Respondent No.3/BMTC issued an Endorsement dated 5.5.2025 stating that they have sought clarification from Respondent No.2/KSRTC and case of petitioners would be considered after receipt of clarification. The petitioners submit that in the final seniority list dated 7.5.2025, there are 129 employees who were shown above the petitioners. When things stood thus, Respondent No.3/BMTC has decided to give promotions on the basis of the said seniority list. Hence, the present petition is filed. 5. During the pendency of the petition, learned counsel for petitioners has filed a memo, which reads as under: "The petitioners in the above writ petition have no objections to this Hon'ble Court to dispose of the writ petition in view of the clarifications issued by by the Respondent No.2 dated 17.6.2025 (Anneuxre-S) and as per the final seniority list dated 28.8.2025, in accordance with law, in the interest of just and equity." 6. Learned counsel for petitioners submits that the petition be disposed of in view of the clarification provided by respondent No.2/KSRTC. - 6 - HC-KAR NC: 2025:KHC:37146 WP No. 15841 of 2025 7. Accordingly, the writ petition is disposed of with a direction to the respondent No.2 to proceed further in consonance with the seniority list and in accordance with law. Ordered accordingly. 8.
