Order on Board 11.09.2025
1. Petitioner has filed this petition contending that the State of Chhattisgarh Health and Family Welfare Department, Mantralaya, Raipur, has issued order dated 30.06.2025, Annexure P1, transferring the petitioner from the Primary Health Centre, Sahwada, District-Kanker to the Primary Health Centre, Sureli, District-Kanker. On the same day, the Collector, District-Uttar Bastar, Kanker has passed petitioner’s another order of transfer from Sahwada to Lakhanpuri. Thus, learned counsel would submit that as there are two transfer orders for the same candidate, it is difficult for her to join at which place of posting.
2. This Court while hearing the petition, on 19.08.2025, has passed an interim
order in favor of the petitioner of no coercive steps against the petitioner pursuant to
Wps 9694 of 2025 2 her transfer order dated 30.06.2025, and directed the State to seek instructions in the matter.
3. State has filed its reply, wherein, at para-8 of the return, it has been stated that as per Clause 4.3 of the Transfer Policy, in case this type of situation created, then priority must be given to the order of the State Government, and corresponding measures to be taken.
4. Learned State counsel would submit that the order of the State Government shall prevail, and he prays for dismissal of this petition.
5. Heard learned counsel for the parties.
6. Considering the fact that two orders have been passed on the same day, therefore, petitioner is directed to make fresh representation within a week from the date of receipt of copy of this order, to the State narrating the factual matrix, and thereafter, the Secretary, Department of Health & Family Welfare, CG will pass an appropriate order within three weeks from the date of receipt of such representation.
7. If the representation is not submitted within the prescribed time, the interim
order passed by the Court will be vacated automatically.
8. It is also directed that respondent/State shall examine the matter looking to the time period given by this Court.
9. With the above observation and direction, present petition stands disposed of.
