1. This criminal misc. bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.150/2024 registered at Police Station Malarna Dungar, District Sawai Madhopur for the offences punishable under Section 3/7 of Essential Commodities Act, 1955. 2. It is submitted by learned counsel for the petitioner that the petitioner is holding the post of Gram Vikas Adhikari, which is a post of Government service in the Department of Rural Development and he has got no control over the sale or purchase of wheat or maintenance of the record by any fair price shop. Only on account of fact that the concerned distributor has failed to maintain the record properly, the petitioner has falsely been implicated in the instant matter. Petitioner is behind the bars since

Learned Public Prosecutor has vehemently opposed this bail application. 4. Considered the submissions made at Bar. 5. In view of the fact that as per the contention of the petitioner, he is not the distributor and was not required to maintain the record of distribution of wheat and is simply holding the post of Village Development Officer as also looking to period of incarceration and the fact that trial against petitioner is likely to take considerably long time, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail. 6.
