Mr. Sanjay Kumar, learned counsel for the private Respondent No.2. 4. In the present Application filed under Section 482 of CrPC, the Applicant has put a challenge to the entire proceedings of Criminal Complaint Case No.1424 of 2023 “Navi Hasan Vs. Smt. Shayma” for the offences punishable under Section 380 of IPC, pending before the court of learned Judicial Magistrate, Kashipur, District Udham Singh Nagar. 5. As per direction passed by this Court on the last date of hearing i.e. on 28.08.2025, the parties in dispute mainly, Applicant – Shayma and the private Respondent No.2 – Navi Hasan, are present before this Court in person along with their learned counsel respectively. After interacting with the parties, there are promising chances that the parties may finally settled their dispute amicably. It is agreed upon that both the parties shall withdraw all the cases, which they have instituted against each other. 6. Learned counsel for the private Respondent submits that Respondent No.2 – Navi Hasan, has also filed a C482 Application before this Court, which is pending. 7. Today the matter is listed for disposal of the compounding application, filed on behalf of the Applicant and private Respondent No.2, with the prayer that they have settled their dispute amicably and do not pursue the matter any further. The said document has been annexed with signatures of the Applicant and private Respondent No.2. The said document has been endorsed by the learned counsels for the parties respectively. 8. The parties are being identified by their learned counsel respectively. On interacting with the parties, the ground for compounding the present matter is sufficient. Accordingly, the compounding application holds water and is allowed. 9. Heard learned counsel for the parties and perused the material available on record. 10. In view of the principle of law laid down by Hon'ble the Apex Court in the case of Gian Singh vs. State of Punjab reported in 2012 (10) SCC 303 as well as in Transfer Petition (Criminal) No. 115 of 2012 (Dimpey Gujral vs. Union Territory of Chandigarh) decided on 06.12.2012, criminal proceedings can be quashed by this Court, if this Court is satisfied that matter has been settled between the parties amicably and parties are interested to restore peace and harmony between them. 11. In view of the above, the compounding application is allowed. The entire proceedings of Criminal Complaint Case No.1424 of 2023 “Navi Hasan Vs. Smt. Shayma” for the offences punishable under Section 380 of IPC, pending before the court of learned Judicial Magistrate, Kashipur, District Udham Singh Nagar, are hereby quashed. 12. The Criminal Miscellaneous Application, filed under 482 of the CrPC is disposed of accordingly.
