---- 4/17.11.2025 Heard learned counsel for petitioner and the learned counsel appearing for the State through Video Conferencing (V.C.).
2. The petitioner is apprehending his arrest in connection with Jagarnathpur PS Case No.164 of 2025, for offence registered under section 341, 323, 379, 498(A), 34 of the IPC, 1860 and section 3/ 4 of Dowry Prohibition Act, 1860, pending in court of learned Judicial Magistrate, 1st Class, Ranchi.

Learned counsel for the petitioner submits that the petitioner happened to be husband of the informant and the petitioner has filed the case before the Family Court under Section 12(1)(C) of Hindu Marriage Act for declaring the marriage null and void and the case has been registered as HMA No.1880 of 2024 and the said case was lodged on 05.11.2024 and thereafter the present FIR has been lodged on
21.04.2025. He also submits that there are general and omnibus allegations of torture and demand of dowry.
4. Learned State counsel opposes prayer and submits that the petitioner happened to be husband of the informant.

Considering that the petitioner happened to be husband of the informant and the petitioner has filed the case before the Family Court under Section 12(1)(C) of Hindu Marriage Act for declaring the marriage null and void and the case has been registered as HMA No.1880 of 2024 and the said case was lodged on 05.11.2024 and thereafter the present FIR has been lodged on 21.04.2025 and there are general and omnibus allegations of torture and demand of dowry, and in that view of that matter, the petitioner is directed to surrender before learned court within two weeks from today and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
