Order on Board 26.08.2025
1. The applicant has preferred this Second Bail Application under Section 482 of B.N.S.S. for grant of regular bail, as he has been arrested in connection with Crime No.348/2025, registered at Police Station : Gandhinagar, Ambikapur District – Sarguja (C.G) for the offence punishable under Sections 420 & 120-B of IPC 1860. 2. The earlier bail application of the applicant was rejected on the ground that the counsel for the applicant had submitted that the applicant had already been arrested, and in view of the same, the application was VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.08.28 14:49:58 +0530
held to have become infructuous. However, it is stated that the submission made by the then counsel for the applicant was not correct, as the applicant had not been arrested in the present case. 3. As per prosecution story, it is prima facie seen that the investigation conducted by the Gandhinagar police station on the basis of written complaint submitted by Miss Preeti Sidar and about 140 other people, R.B Group Space advisor Private Limited's Director Manoj Kumar Pradhan and others opened an office in the Tulsi Chowk Gangapur, thana surguja Chhattisgarh in the year 2022, and by convincing his partner Abhay Gupta to be the Direct Selling Agent (DSA) of all the banks, the said Complainants and others got loans from various banks and on investing 50% of the loan amount in the said fake company, by giving the false assurance that the company itself will pay the installments of the entire loan amount to the banks, by taking out a loan of about Rupees 50 crore in the name of the compliments/loan takers, after getting half of its amount invested in the company, instead of paying the installment of the bank loan, they were found to have closed the office of the company and fled.
Then the police station in-charge Gandhinagar, after taking permission from the Superintendent of Police, investigated the matter and on 17/06/2025, FIR No. 348/2025 has been registered against the Applicant/ Accused Vishnu Prajapati and other 5 Accused under Section 420 and 120 B of IPC. Hence, this application. 4. The applicant respectfully submits that he has been falsely implicated in the present case and has not committed any offence alleged against him. He was working merely as a Sales Executive in the
company of the main accused from November 2022 to June 2023 on a fixed salary basis, without having any connection with the alleged crime or deriving any unlawful gain. The prosecution story is vague and there is no evidence to establish his involvement in the offence. There is no possibility of the applicant tampering with evidence, and the circumstances of the case do not justify pre-trial detention. Though the bail application of co-accused Sudesh Ekka (MCRCA No. 1086/2025) was rejected by this Hon’ble Court on 23.07.2025, the case of the present applicant stands on a different footing as he was only a salaried employee of the company. The applicant is a permanent resident of District Sarguja, Chhattisgarh, and undertakes to appear before this Hon’ble Court during trial, cooperate with the investigation, and not misuse the liberty granted, therefore, he prays for releasing the applicant on regular bail. 5. On the other hand, learned State Counsel appearing for the State/non-applicant opposes the bail application. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, the nature and gravity of the offence alleged against the applicant nature, wherein it is alleged that the applicant, along with co-accused persons, formed R.B. Group through Space Advisory Pvt. Ltd. and induced the complainant and several others to obtain bank loans on the pretext of investing 50% of the amount in trading with an assurance of repaying the EMIs, but subsequently stopped repayment, resulting in huge financial losses to the victims further considering the fact that
approximately 140 persons have allegedly been cheated to the tune of around Rs.
50 crore and that there are also allegations of misuse of documents and involvement of certain bank officials, which shows a larger conspiracy and magnitude of the offence, number of victims, and financial impact are extremely high, as such this Court is of the considered opinion that the second bail application of the applicant is liable to be rejected. 8. Accordingly, the second bail application of the applicant namely, Vishnu Ram Prajapati, involved in Crime No.348/2025, registered at Police Station : Gandhinagar, Ambikapur District – Sarguja (C.G) for the offence punishable under Sections 420 & 120-B of IPC 1860, is rejected.
