JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the accused No.1 under Section 483 of BNSS praying to grant bail in Crime No.183/2025 of Manipal Police Station registered for offences punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the responded -State. 3. Learned counsel for the petitioner would contend that the total quantity of ganja seized from the possession of petitioner is 1.554 kg. The said weight includes the zip plastic covers. The quantity seized is little higher than the small quantity. If the ganja is weighed without plastic covers, it may come to small quantity. The petitioner is in judicial custody since 08.10.2025. As major portion of the investigation is over, he is not required for further custodial interrogation. With these, he prays to allow the petition. 4. Per contra, learned High Court Government Pleader for the respondent –State would contend that the petitioner made payment and got the parcel containing the ganja. The total quantity of ganja seized from the possession of the petitioner is 1.554 kg. The said quantity seized is more than small quantity and less than commercial quantity. The weighing scale and other articles are also seized from the possession of the petitioner. The FSL report indicates that the contraband seized is positive for ganja. The investigation is in progress. With this she prayed to reject the petition. - 4 - HC-KAR NC: 2025:KHC:52609 CRL.P No. 15480 of 2025 5. Having heard learned counsels, this Court has perused the FIR, complaint and other materials placed on record. 6. In the room of the petitioner, plastic parcel cover containing ganja has been seized. In these three separate plastic covers, weighing 454, 457 and 743 grams of ganja has been seized. The weight of the said contraband includes the weight of 03 air zip plastic cover. It is contented that if the plastic cover weight is not included, then it may come to the small quantity. The petitioner is student of B.Sc. Clinical Nutrition and Dietics at Manipal College of Health. The petitioner is in judicial custody since 08.10.2025. If petitioner is continued in judicial custody, it will affect his educational career. The petitioner has undertaken to abide by the conditions to be imposed by this Court. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. - 5 - HC-KAR NC: 2025:KHC:52609 CRL.P No. 15480 of 2025 7. In the result, the following ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No.183/2025 of Manipal Police Station subject to following conditions. a) The petitioner –accused No.1 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the trial Court. b) The petitioner –accused No.1 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.1 shall co-operate with Investigating Officer in further investigation if any. d) The petitioner –accused No.1 shall attend the trial Court on all dates of hearing unless - 6 - HC-KAR NC: 2025:KHC:52609 CRL.P No. 15480 of 2025 exempted and co-operate for speedy disposal of the case. e) The petitioner –accused No.1 shall not involve in commission of any offence. If the petitioner is found involved in commission of any offence, the prosecution is at liberty to move an application seeking cancellation of bail granted to him.
