Neutral Citation No. - 2025:AHC:81473 Court No. - 6 Case :- WRIT - A No. - 17060 of 2015 Petitioner :- Hari Mohan Respondent :- State Of U.P. And 4 Ors. Counsel for Petitioner :- B.S. Pandey,S.K. Agrahari Counsel for Respondent :- Awadhesh Kumar,C.S.C. Hon'ble Saurabh Shyam Shamshery,J. 1. Claim of petitioner for compassionate appointment has lost its efficacy since admittedly mother of petitioner died in harness on 13.05.2001 i.e. almost 2 dozen years ago, therefore, even if it is considered that petitioner was unsuited on a wrong ground since claim was rejected on an allegation of forged document, Court is of considered opinion that at this stage, claim for compassionate appointment cannot be considered. Court also takes note of present age of petitioner which is about 52 years. 2. At this stage, Sri B.S. Pandey, learned counsel for petitioner refers some part of impugned order that petitioner is still entitled for payment of Provident Fund and Gratuity, if due to death of his mother which is still not paid. 3. Learned Standing Counsel submits that if said amount is still not paid, petitioner has liberty to file application along with relevant documents which will be considered in accordance with law. 4. In aforesaid circumstances, while rejecting claim of petitioner for compassionate appointment, this writ petition is disposed of with an observation that if any application is moved for payment of dues i.e. PF and Gratuity, the same will be considered by concerned respondents in accordance with law and a decision will be taken within a short period.
