ORAL JUDGMENT

MFA No.2602/2018 is filed by the husband seeking setting aside of the judgment and decree dated 16.02.2018 passed in M.C. No.5339/2014 on the file of the II Additional Principal Judge, Family Court at Bengaluru, whereby the petition filed under Section 13(1)(ia) of the Hindu Marriage Act, 19551 was dismissed. 2. MFA No.5166/2018 is filed by the wife for setting aside the same impugned judgment and decree dated 16.02.2018 in M.C. No.5339/2014 to the extent a decree of judicial separation is granted. 3. A compromise petition has been filed today in Court, which bears the signatures of the appellant and respondent as well as their respective counsel. The same is accepted on record. Office shall register the same. The terms

of settlement have been incorporated in the aforesaid compromise petition. 4. An application under Section 13B of the HM Act has also been filed today in Court along with joint affidavit of the parties. The application and the affidavit also bear the signatures of the advocates for identifying the parties. The applicants jointly pray for grant of a decree of divorce by mutual consent. The office shall register the same. 5. We have perused the joint affidavit filed by the parties. 6. As noted above, the parties have already entered into a settlement which is by means of a compromise petition. Since the parties have now amicably settled their difference, bring to a close the matrimonial dispute between the parties pending since 2014, we deem it fit to allow the application under Section 13B of the HM Act.
The impugned judgment and decree is set aside and we direct that the marriage of the parties solemnized on 28.11.2004 at S.K.R. Convention Hall, Bengaluru be dissolved. - 6 -

7. The parties have entered into the aforesaid settlement and the terms of the settlement shall form part of the decree. The amount of ₹3,43,000/- that remains deposited in the Registry and is stated to be placed in a Fixed Deposit Account, on a proper application being made by the wife, the amount along with the accrued interest if any, shall be paid to the wife as per Rules. 8. The Court fees paid by the parties in respect of the aforesaid appeals shall be refunded to the concerned parties, by whom the same have been respectively paid, in terms of Section 66 of the Karnataka Court Fees and Suits Valuation Act,
