JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner is appointed as a 'Member' of the fourth respondent’s Managing Committee, and he is aggrieved by the fourth respondent's decision to keep his membership under suspension. The fourth respondent is represented by its President. The action is because of certain untoward incidents during a Meeting on 20.08.2025 with the petitioner raising his voice and the fourth respondent saying that the - 4 - HC-KAR NC: 2025:KHC:38284 WP No. 28839 of 2025 petitioner is not justified in the use of certain language. Sri Vivek Subba Reddy, the learned Senior Counsel for the petitioner, and Sri V Krishnamurthy, the learned counsel who is on caveat for the fourth respondent, are heard for disposal. If Sri Vivek Subba Reddy proposes to argue on the fourth respondent’s jurisdiction, Sri V Krishnamurthy, while substantiating the decision, refutes argument about the lack of jurisdiction. However when queried, Sri Vivek Subba Reddy submits that the petitioner who is present before this Court will tender an apology regretting the outcome of a well-intended action. Sri V Krishnamurthy is also heard in the light of the afore. If the reason for the impugned order is only because of certain utterances in a charged environment, and if there are no other allegations [as - 5 - HC-KAR NC: 2025:KHC:38284 WP No. 28839 of 2025 it is in the present case], this Court is of the view that with the petitioner regretting and even tendering an apology through this Court to the fourth respondent, the petition must be disposed of dissolving the fourth respondent's Order dated 02.09.2025 [Annexure-A]. The petition stands disposed of accordingly leaving all legal questions open for due consideration with the hope that there would be no reason for such consideration.
