GP FOR SERVICES II The Court made the following: 4 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO: 5653/2023 AND WRIT PETITION NO.7010/2023 COMMON ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of 3rd respondent in terminating the petitioner vide proceedings Ref.No.72/A/2022 dated 20.10.2022 with retrospective effect i.e., from 23.11.2020 without issuing any notice or affording opportunity of hearing from the post of Angawadi Worker, Ramesampeta Anganwadi Center, Code No.84 of Kotapadu Village of Rangampeta Mandal of East Godavari District is highly illegal, arbitrary, contrary to the guidelines issued by the Government and judgments of this Hon’ble Court and also violation of principles of natural justice apart from violating the Article 14, 16 and 21 of Constitution of India and consequently direct the respondents to allow to perform her duties as Anganwadi worker in the interest of justice and pass such other order. 2. This contempt case is filed against the respondents for willful disobedience of the orders dated 28.03.2023 passed by this Court in W.P.No.7010 of 2023. 3. Heard the learned counsel for the petitioner and the learned counsel for the respondents. 4. Learned counsel for the petitioner submits that this Court passed an interim order dated 28.03.2023 in W.P.No.7010 of 2023, which is extracted hereunder: 5 “Heard learned counsel for the petitioner as well as learned Government Pleader for Services appearing for the respondents. There shall be an interim suspension of the impugned proceedings dated 20.10.2022 issued by the 3rd respondent and the respondents are directed to allow the petitioner to discharge her duties as Anganwadi Worker, Ramesampeta Anganwadi Center, Code No.84, Kotapadu Village of Rangampeta Mandal, East Godavari District, until further orders. List the matter after two weeks for filing counter.” 5. Learned counsel for the petitioner further submits that even though this Court passed an interim order dated 28.03.2023 directing the respondents to allow the petitioner to discharge her duties as Anganwadi worker, the respondents did not comply with the order of this Court. Hence, the Contempt Case is filed. 6. On the other hand, learned counsel for the respondents submits that in compliance of the order of this Court dated 28.03.2023, the respondents issued a speaking order dated 22.11.2025 reinstating the petitioner and the petitioner has also joined duty on 21.11.2025. Hence, no further orders are required to be passed in the contempt case. 7. Learned counsel for the petitioner also admitted the same. He further submits that since the respondents complied with the order of this Court, the cause in the Writ Petition does not survive and no further adjudication is 6 necessary in the present Writ Petition. Therefore, the Writ Petition becomes infructuous. 8. Recording the said submissions, the Contempt Case is closed. 9. The Writ Petition is dismissed as infructuous. No order as to costs.
