03/ 11.12.2025 Heard learned counsel appearing for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Petarbar P.S. Case No. 91 of 2025, registered for the offences under Sections 126(2), 115(2), 117(2), 109(1), 303(2), 324(2), 329(4), 351(2), 352, 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat.

Learned counsel appearing for the petitioners submits that

there are case and counter case between the parties and general and omnibus allegations are there against the petitioner of making assault. She submits that the injury is found to be simple in nature.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegation of assault is there and the informant has received the injury.

Looking into the contents of the FIR, it transpires that there are general and omnibus allegations against all the accused persons and it has not been disclosed that on whose assault, simple injury has been caused, I am inclined to provide privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat, in connection with Petarbar P.S. Case No. 91 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
