The instant Criminal Petition is filed under Section 528 of the BNSS, by the Petitioner herein, to quash the proceedings against her in C.C.No.74 of 2024 on the file of the learned II Special Magistrate, Vijayawada.
2. Heard Ms.C.S.Hema, learned counsel for the petitioner and Ms.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent/State.

3. Learned counsel for the petitioner would submit that the petition may be disposed of dispensing with the presence of the petitioner before the trial Court and the petition may be disposed of.
4. As seen from the contentions raised in the present petition, which are in the nature of a defence, this Court cannot quash the case on the basis of the petitioner’s defence in C.C. No. 74 of 2024.
5. In that view, the Criminal Petition is disposed of. However, whenever the petitioner is unable to appear before the trial Court, she can make such request through her counsel to condone her absence without causing any disturbance to the trial.
