GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 19398 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a Writ, order or direction more particularly one in nature of Writ of Mandamus, declaring the action of Officials of Respondent No.3 in issuing directions to Petitioner to relinquish her rights over Agriculture Land admeasuring an extent of Ac 10- 09 Cents in Survey No.155, situated at Gooty Venkatampalli Village, Peddavaduguru Mandal, Anantapur District the Suit subject matter of OS.No.242 of 2018 on the file of Honourable Junior Civil Judge. Gooty, OS.No.200 of 2020 on the file of Honourable Junior Civil Judge, Gooty as illegal, arbitrary and consequently direct the Officials of Respondent No.3 to not to call the Petitioner for resolving any Civil dispute with respect to Agriculture Land admeasuring an extent of Ac 10-09 Cents in Survey No.155, situated at Gooty Venkatampalli Village, Peddavaduguru Mandal, Anantapur District.…” 2. Heard Sri N.Chandra Sekhar Reddy, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the police are calling the petitioner to the police station and threatening to settle the civil disputes between the petitioner and the unofficial respondents. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that there are civil disputes between the petitioner and the unofficial respondents and both parties are quarrelling regarding the subject land frequently. On 25.07.2023, the 3rd respondent with a view to maintain law and order, addressed a letter to the Tahsildar & Mandal 4 Executive Magistrate, Peddavaduguru, with a request to summon both the parties and bind them. He would further submit that both parties appeared before the Mandal Executive Magistrate, Peddavaduguru and were bounded over vide M.C.No.47 of 2023 dated 25.07.2023. Except the above, the respondent police never called the petitioner for resolving any civil disputes between the parties. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
