The present petition has been filed under Section 482 of Cr.P.C. is for quashing of impugned order dated 30.09.2002 passed by learned SDJM, Ludhiana declaring the petitioner as proclaimed offender in case FIR No. 242 dated 28.11.2001 under Sections 406/420 IPC registered at Police Station Jagraon, Ludhiana Rural (Annexure P-1/T) along with all subsequent proceedings on the basis of compromise (Annexure P-2). 2. Learned counsel for the petitioner submits that petitioner has been declared as proclaimed offender in case FIR No.242 dated 28.11.2001. The provisions of Section 82 Cr.P.C. were not followed as the petitioner was actually residing abroad and he was not served properly and was not even aware of the proceedings. He further submits that co-accused of the petitioner have been acquitted in the meanwhile. Learned counsel for the petitioner undertakes that petitioner is ready and willing to come from abroad and face the trial before the concerned Court within four weeks from the date of passing of this order as he is shifting his residence.
