Petitioner is aggrieved by the fact that inspite of a representation dated 01.08.2023 and after purchasing the vehicle in an auction from Indusind Bank which has been also approved by the Indusind Bank, the previous defaulting borrower with the aid of miscreants have forcefully taken away the vehicle. Police authorities were informed. It has been submitted on behalf of the petitioner that a criminal case has already been registered being Dankuni Police Station case no. 298/2023. Police authorities are directed to seize the vehicle from the defaulting borrower and present the same before the Jurisdictional Court in siesin of the matter. It would be for the petitioner or the person from whose possession the vehicle is being repossessed along with Indusind Bank to place their claim before the learned ACJM in siesin of the case. 2 It is reiterated that the police authorities would put in efforts so that all steps are taken for recovery of the said vehicle which is the subject matter of the case. If required assistance of the Superior Officer be taken by the Investigating Officer of the case and the aforesaid process would continue inspite of any charge-sheet already having been submitted before the Court. With the aforesaid observations WPA 21682 of 2023 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
