Tiwari, A.P.P. --- 03 / 27.03.2025 Heard the parties. 2. Petitioner has been made accused in connection with Balumath P.S. Case No. 111 of 2024 for the offences registered under sections 326(f), 308(2), 308(3), 308(4), 308(5), 285, 324 (5), 111(2)(6), 111(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 17 of C.L.A. Act, pending in the court of learned Chief Judicial Magistrate, Latehar. 3. On 01.10.2024 at 2.00 a.m., Hywa of the Informant Company bearing registration no. JH 01EU 9291 was burnt by the naxals at Kanta No. 19 situated on main road near Phulbasiya Siding. Occurrence has taken place to enforce the demand of levy. 4. It was submitted that the petitioner is neither named in the FIR, nor he was put on T.I. Parade. It was further submitted that the name of the petitioner has come in the confession of other co-accused persons. 5. Mr. Abhay Kumar Tiwari, learned A.P.P after going through the case diary, also submitted that the name of the petitioner has come in the confession of co-accused. However, he has submitted that the petitioner has got criminal antecedent. 6. Considering the fact that apart from the confession of co-accused, there is no other material against the petitioner on the record, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath P.S.
