This criminal miscellaneous petition has been filed under section 528 of BNSS, 2023 by the petitioner with the prayer for modification of the order dated 09.07.2021 passed in ABA No. 4196 of 2021. It is submitted by the learned counsel for the petitioner that vide order dated 09.07.2021 passed in ABA No. 4196 of 2021, the petitioner was directed to surrender before the court below within six weeks, with the condition that the co-accused Sonu Rai appears in the court concerned and to deposit Rs. 10,000/- as cash security but due unavoidable circumstances, the petitioner could not surrender within the stipulated time but now, the petitioner is ready to surrender in terms of the order dated 09.07.2021 passed in ABA No. 4196 of 2021 and has also deposited the said cash security, the copy of which is kept at page 6 of the supplementary affidavit of the brief and the co-accused Sonu Rai is arrested by the police after institution of the case. Learned counsel for the petitioner submits that the time to surrender before the court below in terms of the order dated 09.07.2021 passed in ABA No. 4196 of 2021 be extended for six weeks from the date of this order. Considering the facts of the case and the submission of the learned counsel for the petitioner, the prayer for extension of time for the petitioner to surrender in the court below in terms of the order dated 09.07.2021 passed in ABA No. 4196 of 2021 is allowed. Hence, the petitioner is directed to surrender before the court below “within six weeks from the date of this order in terms of the order dated 09.07.2021 passed in ABA No. 4196 of 2021”. The order dated 09.07.2021 passed in ABA No. 4196 of 2021 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly. (ANIL KUMAR CHOUDHARY, J.)
