Suawati W/o Shri Hemraj, Aged About 39 Years, R/o Pratap Nagar, Opp. Ladduram Samadhi, Gangapur City. ----Petitioners Versus Amzad Khan S/o Maksood Ahmad, Aged About 34 Years, R/o Near Bandariya Ke Balaji, Triok Nagar, Gangapur City, Tehsil Gangapur City, District Sawai Madhopur (Raj.) ----Respondent For Petitioner(s) : Mr. Manjeet Sharma, Adv. For Respondent(s) : Mr. D. K. Dixit, Adv. HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA Order 03/01/2025 The instant petition has been filed by the petitioners- defendants(for short ‘the defendants’) against the order dated 01.04.2021 passed by the Civil Judge, Gangapurcity (Sawai Madhopur) in Civil Suit No.47/2021 (for short ‘the trial court’), whereby the trial court while allowing the prayer of ad-interim injunction, directed not to dispossess the plaintiff-applicant from the disputed plot in question till further order. Taking into consideration the facts and circumstances of the present case and more particularly in view of the fact that by the impugned order, temporary injunction application was not decided finally. Instead of interfering with the impugned order, I dispose of civil writ petition with a direction to the trial court to decide the (2 of 2) [CW-1523/2022] temporary injunction application, if pending with it, finally, expeditiously, in accordance with Law. Registry is directed to send a copy of this order to the concerned trial court forthwith for information and compliance. Pending application(s), if any, also stand(s) disposed of.
