ORAL ORDER
This petition is filed by the sole accused under Section 483 of BNSS praying to grant bail in SC No.15022/2024 (Crime No.172/2023 of Vishwanathapura Police Station) registered for offence under Section 302 of IPC, pending on the file of the V Additional District and Sessions Court, Bangalore Rural District, sitting at Devanahalli.
2. Heard learned counsel for petitioner and learned HCGP for respondent/State.
3. Learned counsel for petitioner would contend that material witnesses have been examined and they have not supported the case of the prosecution. The remaining witnesses are official/police witnesses and there are no chances of this petitioner harassing and threatening them. The petitioner is in judicial custody since 12.10.2023. With this he prayed to allow the petition.

Per contra, learned HCGP would contend that the allegation against the petitioner is that he killed his daughter as she was loving a person belonging to lower caste and she has broken her engagement made by the petitioner with the other person. The alleged killing by the petitioner is honor killing. If the petitioner is granted bail, there are chances of him absconding and delaying the trial. With this, she prayed to reject the petition.
5. Having heard the learned counsels, the Court has perused the charge sheet and other materials placed on record.
6. The petitioner alleged to have committed murder of his daughter when she was sleeping in the house by assaulting her with club on her head and also assaulting with knife on her neck. The deceased was daughter of petitioner and was loving a person belonging to lower caste. She has also broken her engagement with another person. CW.1 is stated to be the wife of this petitioner and an eye witness to the incident has already been examined and she has not

supported the case of the prosecution. The prosecution has already examined 17 witnesses. The prosecution has to examine remaining officials/police witnesses. Since material witnesses are already examined, there is no question of petitioner threatening the prosecution witnesses who are officials/police witnesses. The petitioner is not having criminal antecedents. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following:
ORDER
The petition is allowed. The petitioner is granted bail in S.C.No.15022/2024 (Crime No.172/2023 of Vishwanathapura Police Station) pending on the file of the V Additional District and Sessions, Bengaluru Rural, sitting at Devanahalli, subject to following conditions: (i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety

for the like sum to the satisfaction of the trial Court.
(ii) The petitioner shall not threaten the remaining prosecution witnesses. (iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
