HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE BHUWAN GOYAL Order 05/08/2025 Counsel for the appellants submits that the learned Single Judge while deciding the writ petition vide order dated 18.01.2021 relied upon the judgment passed by the Single Bench in the matter of Bajrang Lal Vs. State of Rajasthan, S.B. Civil Writ Petition No.24227/2017, decided on 15.01.2021, against which the State filed appeal-D.B. Special Appeal Writ No.599/2021 which
(2 of 2) [SAW-1199/2022] was allowed by the Division Bench of this Court vide order dated 08.12.2021 and therefore prayed that the order passed by the learned Single Judge in the present matter dated 18.01.2021 be quashed and set aside. Counsel for the respondent submits that since the matter was not considered on merits and the same was disposed of in the light of the judgment passed in the matter of Bajrang Lal (supra), therefore prayed that the matter be remanded back to the learned Single Judge for deciding the same on merits. Heard counsel for the parties and perused the record. Admittedly, the matter was not considered by the learned Single Judge on merits of the case, therefore, in the changed circumstances as narrated above, We deem it just and proper to remand the matter back to learned Single Judge for deciding the same on merits. In that view of the matter, the appeal filed by the appellants is allowed. The order dated 18.01.2021 passed by the learned Single Judge is quashed and set aside. The writ petition No.8422/2019 is restored to its original number. We request the learned Single Judge to decide the same on merits.
