The police registered the offence under Section 137(2) of B.N.S., 2023 and started investigation. 4.
Learned counsel for the applicant would submit that the victim is a major girl having love affair with the applicant, had herself gone to the house of the applicant and engaged in making consensual sexual relation with him. There is no legally admissible evidence with respect to her age in the charge sheet and it is only under the pressure of her parents she made statement against the applicant. The applicant is in jail since 26-04-2025 and final adjudication of the case will take its own time. Therefore, the applicant may be enlarged on bail.
5.
Learned counsel for the State opposes the bail application.
6. Considering the submissions made by the learned counsel for the parties, considering the nature of allegation and the material collected during the investigation, further considering the age of the victim and after perusing her her statement under Section 183 of B.N.S.S., 2023, further that the applicant is in jail since 26-04-2025, without commenting anything on merits of the case I am inclined to release the applicant on bail.
