2. The grievance of the petitioners / plaintiffs in O.S. No.33 of 2025 on the file of the Court of Civil Judge (Junior Division), Palamaner, in short, is that I.A. No.50 of 2025 filed in the said suit, seeking temporary injunction under Order XXXIX Rules 1 and 2 and Section 151 of Civil Procedure Code, is not being taken up for consideration. 3. The learned counsel for the petitioners referring to docket proceedings filed on 13.11.2025, inter alia submits that despite service of notice on the defendants in the said suit, the matter is being adjourned for filing counter affidavits. He submits that though the said I.A., was filed along with the suit, for the specific reasons set out in the affidavit filed in support of the I.A., and the urgency is explained, the learned Civil Judge, instead of considering the matter, has been adjourning the same from time to time and as a result of which, the very object of filing the I.A., will be defeated.
He submits that the matter is posted to 22.12.2025 and unless the said I.A., is directed to be disposed of expeditiously, the petitioner suffers serious prejudice and great hardship. 4. Considering the said submissions, the Civil Revision Petition is disposed of, providing that the learned Civil Judge (Junior Division) shall make endeavour to dispose of the I.A., referred to above, after giving opportunity to both sides, strictly in accordance with law, as expeditiously as possible, within a period of eight (8) weeks from the date of receipt of a copy of this order.
