JUSTICE RAJESH SHANKAR ----- For the Petitioners: Mr. Awadhesh Pandey For the Respondents: Mr. Mohan Kr. Dubey, A.C to A.G ----- 04/08.04.2025 The present writ petition has been filed for issuance of direction upon the concerned respondents to pay compensation to the petitioners for the houses and structures erected over the concerned land, as they are the land losers under Bhairwa Reservoir Project in the district of Ramgarh after acquisition of their land way back in the year 1988-89. The petitioners have also prayed for directing the concerned respondents to extend them the rehabilitation benefit being the land losers under the said project. 2. Learned counsel for the petitioners submits that a similar writ petition being W.P.(C) No. 4359/2021 (Mantu Kumar Mahto & Ors. Vs. The State of Jharkhand & Ors.) was filed before this Court, which was disposed of vide order dated 06.06.2022 in the following terms: ‘’Accordingly, the present writ petition is disposed of giving liberty to the petitioners to file individual claim/objection along with relevant documents with respect to payment of compensation for their houses which existed over the land acquired for Bhairwa Reservoir Project in the district of Ramgarh before the respondent no.5. On receipt of the said objection, the respondent no.5 shall take an appropriate decision with respect to individual 2025:JHHC:10830 4 claim/objection of the petitioners on the basis of material available on record and prepare a fresh valuation chart for payment of compensation with respect to the houses which existed over the acquired land. The respondent no.5 shall thereafter send the said valuation report to the respondent no.6, who shall determine the compensation to be paid to the petitioners, if they are found entitled and make effective payment to them. The said exercise is to be completed by the concerned respondents within three months from the date of filing of the individual claim/objection by the petitioners.’’ 3. Mr. Mohan Kr. Dubey, learned A.C to A.G appearing on behalf of the respondents, accepts that the aforesaid writ petition was filed making similar prayer as that of the present writ petition. 4. Considering the aforesaid submission of learned counsel for the parties, the present writ petition is also disposed of in terms with the aforesaid order. In addition to the aforesaid direction, it is also observed that the petitioners may also claim for rehabilitation benefit, which shall be appropriately dealt with by the respondent No.6 within the aforesaid period.
