GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 10978/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue any writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos. 4 and 5 in interfering with the civil disputes and obtaining 10 signed promissory notes by manhandling the petitioner as illegal and arbitrary and consequently direct the said respondents to return the said promissory notes to the petitioner.…” 2. Heard Sri Raja Reddy Koneti, learned counsel for the petitioners and Sri.P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned Assistant Government Pleader for Home, on instructions, would submit that basing on the complaint of one Pentareddy Sudhakar Reddy, a case in Cr.No.115 of 2023 of Atchampet P.S., under Sections 420 & 506 r/w 34 of IPC, against the petitioner. Except registering the above crime, the police never interfered in the civil disputes between the petitioner and third parties. 4. Learned counsel for the petitioner would submit that the respondent Nos. 4 and 5 obtained empty promissory notes along with the signatures of the petitioner in this matter. He would further submit that let there be a direction to the police to return such promissory notes. 4 5. Per contra, learned Assistant Government Pleader for Home overtly denied the same and would submit that the police never obtained any such promissory notes from the petitioner. The case is under investigation. 6. Considering the submissions, this Writ Petition is disposed of. However, the police are directed to conclude the investigation and file a report in Cr.No.115 of 2023 of Atchampet P.S., as expeditiously as possible. The petitioner is at liberty to recourse his remedies before the appropriate forum. No order as to costs.
