Order 19/09/2025 The instant application has been filed on behalf of the petitioner No.2/applicant Smt. Savita Meena for recalling the order dated 04.11.2024 passed in S.B. Criminal Misc. Petition No.2672/2016 whereby the petition has been dismissed as infructuous.
(2 of 2) [CRLMA-177/2025]
Learned counsel submits that inadvertently, on 04.11.2024, the aforesaid petition has been dismissed as infructuous whereas same has not become infructuous and the petitioner still wants to pursue the misc. petition for quashing of FIR No.380/2014 Police Station Kotwali for offences under Sections 420, 467, 468, 471, 409, 385, 193, 195, 196, 197, 198, 167, 120B IPC. He also submits that if the order dated 04.11.2024 is not recalled, the petitioner/applicant would suffer irreparable loss. It is thus prayed that the order dated 04.11.2024 may be recalled and the petition may be restored to its original position and number. The aforesaid petition was dismissed as infructuous on the statement of Shri Amit Swami, who appeared before the Court on that day but today, it has been argued that grievance of the petitioner still survives and she wants to pursue it. Thus, after considering the submissions advanced by learned counsel for the petitioner and in the interest of justice, the application is accepted. The order dated 04.11.2024 is recalled. The misc. petition is restored to its original number and position.
