JUSTICE SAMEER JAIN
Judgment 13/10/2025
1. The present bail application has been filed under Section 482 BNSS in connection with FIR No. 200/2025 registered at Police Station Sarwar District Ajmer for the offence(s) under Sections 115(2), 126(2), 3(5) of BNS, 2023.
2.
Learned counsel for the accused-applicant has contended that in the FIR, complainant is alleging that the injury has been inflicted upon the complainant and his father Harchand, however, the same is not backed by any evidence.
3. Per contra, learned Public Prosecutor has vehemently opposed the bail application.
4. Having heard the contentions made by the counsel accused- applicant, upon a perusal of the material available on record, specially the case diary wherein it is reflected that the injured person is Sukhlal i.e. uncle of complainant, however, the FIR itself
[2025:RJ-JP:41657] (2 of 2) [CRLMB-11660/2025] reflects that there is no person, other than Harchand who has received injury; that prima facie (as superficially observed) it is allegation of identity crises; but, without commenting upon the merits/demerits of the case, this Court is inclined to allow the anticipatory bail application subject to a condition that applicant shall join the investigation on 30.10.2025 on 11.00 am.
6. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Sarwar District Ajmer in F.I.R. No. 200/2025 is directed that in the event of arrest of the accused-applicant Om Prakash S/o Kana shall be released on bail, provided he/she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the applicant shall make himself available for interrogation by a police officer as and when required; and if the applicant fails to join and render due cooperation in the investigation or does not mark appearance before the concerned authority, as directed hereinabove, the present
order allowing anticipatory bail to the applicant shall cease to operate; (ii) that the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the applicant shall not leave India without previous permission of the court.
