Heard Mr. B. Taipodia, learned counsel for the applicant. Also heard Mr. J. Tsering, learned Special Public Prosecutor for SIT.
2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for grant of privilege of pre-arrest bail to the applicant namely, Shri Prem Bahadur Tamang in connection with Namtok
Page No.# 2/3 P.S. Case No. 01/2023, under Section 379/34 of the IPC, read with Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957.

By an Order dated 09.01.2025, this Court granted interim anticipatory bail to the accused/applicant with a direction to release him on execution of a bail bond of Rs. 15,000/- (Rupees Fifteen thousand) only with one surety of like amount to the satisfaction of the arresting authority and to appear before the I.O of the case within 7(seven) days.
4. Mr. J. Tsering, learned Special Public Prosecutor while referring to the Case Diary submits that in compliance of the direction of this Court, the accused/applicant had appeared before the Investigating Officer on 15.01.2025 and on such appearance, the Investigating Officer has examined him and recorded his statement under Section 161 of Cr.P.C. He further submits that the involvement of the accused/applicant is not found in the case.
5. In view of the above submission of the learned Special Public Prosecutor, the interim anticipatory bail granted to the accused/applicant on 09.01.2025 is hereby regularized and made absolute with the same terms and conditions as in
order dated 09.01.2025.
6. This anticipatory bail application shall be read as part of the order dated
09.01.2025.
7. Accordingly, the anticipatory bail application stands disposed of.
