Though the matter is listed today for preliminary hearing. With the consent of counsel for the respective parties it is heard. 3. The captioned Writ Petition is filed seeking following reliefs: a. Issue a Writ of Certiorari or any other appropriate writ, order or direction quashing the show cause notice bearing No.245859 dated: 06.07.2025 issued by the second respondent vide Annexure-C; b. Declare that the second respondent has no jurisdiction to initiate proceedings in respect of the incident alleged to have occurred outside his territorial area; c. Declare that Section 182(4) of the Motor Vehicles Act, 2019 does not apply to stationary vehicles parked within private premises, particularly where "private premises" is not defined under the Act; - 3 - HC-KAR NC: 2025:KHC:26556 WP No. 20783 of 2025 Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care. 4. Suffice it to note that the second respondent issued a show cause notice on 06.07.2025 intimating the following offence "Motor Vehicle found front registration number plate not fitted". AGA submits that the petitioner may be directed to submit a suitable reply and the authority would consider the same in accordance with the law. The oral submission made by AGA is placed on record. Annexure-C is only a show cause notice issued to the petitioner. Hence, this court deems it proper to direct the petitioner to submit his reply within two weeks from the receipt of certified copy of this order. Upon receipt of such reply, the authority concerned shall consider the same in accordance with the law within two weeks thereon. All the contentions of the parties are left open. 5.
