THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.27339 of 2025
ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“….to issue a writ one in the nature of writ of mandamus by declaring the action of the respondent authorities in attempting to dispossess the petitioner from her land bearing S.Y.No. 301, 299, 299B2, 299C, 299e in the name of survey, and issuing notice by the instance of 7th respondent to conduct the survey in land bearing S.Y.No. 301, 299, 299B2, 299C, 299e situated at Mandigiri Village, Adoni Mandal, Kurnool District, without following due procedure of law, without considering my representation dated 20.09.2025 as illegal arbitrary and violation of Article 14, 19, 21, 300A of constitution of India, apart from violative of rule 20 of BSO 34- A, and AP Survey and Boundaries Act and consequently direct the respondents authorities not to interfere with the peaceful possession of petitioner and enjoyment of the petitioner from her lands, and not to conduct any survey without following due process of law….”
2. Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 6. In compliance to the earlier orders, the
4
petitioner has served notice to the 7th respondent. Despite notice being served, none entered appearance for respondent No.7. 3. In fact, the respondents have issued notice on 16.09.2025 based on the application filed by the 7th respondent to conduct survey of the land in Survey No.299 and to provide boundaries. As against the same, the petitioner has submitted objections on
20.09.2025. Now, the grievance of the petitioner is that without considering the said objections, the respondents are proceeding with the survey and by means of the alleged survey the respondents are trying to interfere with the possession of the petitioner. 4. Learned Assistant Government Pleader placed on the written instructions received from the 4th respondent dated 08.09.2025, wherein it is revealed that the entire land in Survey No.299 is subdivided and belongs to so many persons and the adjacent Survey No.301 is a patta land of the petitioner. In compliance to the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923 (for short, „the Act‟), they issued notice to the petitioner and she submitted an explanation and with an
5
apprehension the petitioner has approached this Court. Even the respondents have not conducted any survey so far. 5.
Considering the said submissions, the Writ Petition is
disposed of directing the respondents to consider the objections filed by the petitioner on 20.09.2025 and also by issuing a fresh notice by calling objections from all concerned and conduct survey as per the provisions of the Act. Till such exercise is completed, the respondents are directed not to interfere with the possession of the petitioner in respect of the subject land. There shall be no order as to costs.
As a sequel, miscellaneous petitions, pending if any, shall stand closed. _______________________ JUSTICE D.RAMESH
