Neutral Citation No. - 2025:AHC:56336-DB Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 7062 of 2025 Petitioner :- Lovakush Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Akhilesh Kumar Tiwari Counsel for Respondent :- G.A. Hon'ble Vivek Kumar Birla,J. Hon'ble Praveen Kumar Giri,J. 1. Heard Sri Sampurnanand, holding brief of Sri Akhilesh Kumar Tiwari, learned counsel for the petitioner is praying for adjournment on the ground of illness of the learned counsel for the petitioner. 2. We find that on the earlier occasion also learned counsel for the petitioner prayed for adjournment and on his request the case was directed to be listed on 17.4.2025 i.e. today. 3. Present petition has been filed challenging the impugned order dated 3.10.2022, registered as Case Crime No. 0209 of 2022, under Sections 376, 504, 506, 427 IPC and 3(2)(v) of SC/ST Act, P.S. Mau, District Chitrakoot. 4. Sri Pankaj Kumar, learned AGA submits that the first information report is of the year 2022 wherein chargesheet no. 99 of 2023 has been forwarded on 2.6.2023 and the petitioner is absconding and even after proceedings against him under Section 82/83 CrPC provisions of Section 174(A) IPC have also been invoked by filing FIR. 5. We, therefore, find no good ground to adjourn the matter. The chargesheet has already been submitted, therefore, no relief can be granted to the petitioner as present petition has become infructous. Even otherwise, on perusal of the first information report, a cognizance offence is made out. 6. Present petition is accordingly dismissed.
