( 2025:JHHC:32892 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 8483 of 2025 ------ Shahid Hussain @ Md. Shahid Hussain, aged about 45 years, son of Sattar @ Md. Sattar Ansari, resident of Village – Matwari, P.O. and P.S. –Korrah, District –Hazaribagh (Jharkhand) … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Sahil, Advocate For the State : Mrs. Kumari Rashmi, Addl. P.P. ------ Order No.04 Dated- 31.10.2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with S.T. No. 19 of 2025, arising out of Chandwara P.S. Case No. 76 of 2024 registered for the offences punishable under sections 115(2), 117(2), 123, 127(2), 64(2), 351(2) and 3/5 of the B.N.S., 2023. The learned counsel for the petitioner submits that this is the second journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was rejected vide order dated 06.05.2025 in B.A. No. 3766 of 2025. It is further submitted by the learned counsel for the petitioner that the only fresh ground is that in the meanwhile, all the prosecution witnesses have been examined and some of them have supported the case of the prosecution, whereas some other witnesses have turned hostile. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that the prosecutrix has supported the case of the prosecution and the same in itself is sufficient to bring home the charges against the petitioner, therefore, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail. Considering the serious nature of allegation against the petitioner and the evidence that has come through the witnesses including the prosecutrix as well as the chances of the petitioner absconding, if released on bail, this Court is not inclined to admit the petitioner on bail. Accordingly, the prayer for regular bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) 31.10.2025 Sonu/Gunjan-
