No.766 of 2018, vide Lok-Adalat Award dated 14/09/2024 and not closing the same, as illegal, arbitrary, violation of Principles of Natural Justice, violation of Articles-14 and 21 of the Constitution of India and violation of Police Standing Orders Nos.701 and 702 and also violation of settled Law laid by the Hon'ble Supreme Court of India and this Honble Court, and consequently direct the Respondents to close the Suspect Sheet, and pass

The Court made the following:
ORDER:
This Writ Petition is filed under Article 226 of Constitution of India by the Petitioners, with the following prayer for:
“.... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents in continuing the Suspect Sheets against the Petitioners in spite of acquittal in criminal case, in C.C. No.766 of 2018, vide Lok-Adalat Award dated 14/09/2024 and not closing the same, as illegal, arbitrary, violation of Principles of Natural Justice, violation of Articles-14 and 21 of the Constitution of India and violation of Police Standing Orders Nos.701 and 702 and also violation of settled Law laid by the Hon'ble Supreme Court of India and this Honble Court, and consequently direct the Respondents to close the Suspect Sheet, and pass … .”
Learned counsel for the Petitioners would submit that the Petitioners were falsely implicated in the said case and that the offence alleged against him does not relate to breach of public peace and tranquility, further, the case is closed in Lok Adalat and in spite of Award passed by the Lok Adalat on 14.09.2024 to that effect, the suspect sheet opened against the Petitioners is not closed.
Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that, no cases pending against the Petitioners.
Accordingly, the Writ Petition is allowed and the impugned rowdy sheet against the Petitioners is hereby set aside. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
