This petition under Section 528 of the B.N.S.S. is filed for quashing and setting aside charge-sheet dated 22.11.2024 as well as cognizance/summoning order dated 15.01.2025 passed by leaned Additional Chief Judicial Magistrate, Kotdwar, District Pauri Garhwal along with entire proceeding of Criminal Case No.111 of 2025 (Case Crime No.164 of 2024) “State Vs. Abhishek Kumar & Others” for the offences punishable under Section 420, 120-B and 34 of IPC, Police Station Kotdwar, District Pauri Garhwal qua the petitioners, in view of the compromise arrived at between the parties. 2. In view of the fact that a Compounding Application was filed by the parties before this Court, this Court vide order dated 19.03.2025 had directed 1 2025:UHC:2650 the parties to appear before the Secretary, DLSA, Pauri in order to get their statements recorded and to verify the compromise deed. 3. Pursuant to such order, the Secretary, DLSA, Pauri has submitted his report dated 25.03.2025 which clearly indicates that the parties have settled the dispute amicably and have also verified the contents of the compromise. 4. In view of the above, Compounding Application (IA No.1 of 2025) is allowed. As a consequence thereof, the entire proceedings of Criminal Case No.111 of 2025 (Case Crime No.164 of 2024) “State Vs. Abhishek Kumar & Others” for the offences punishable under Section 420, 120-B and 34 of IPC, Police Station Kotdwar, District Pauri Garhwal are hereby quashed qua the petitioners. 5.
