This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending her arrest for offences under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 11(1) (a), 11(1)(d), 11(1)e, 11(1)f, 11(1)h, 11(1)k of the Prevention of Cruelty to Animals Act, 1960. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The petitioner is a lady. She is the registered owner of the vehicle upon which a brown colour calf was being transported. 5. Considering the fact that the petitioner is a lady and it is only the case of transportation and there was only one calf in the said vehicle, I am inclined to allow this application. 6. Considering the nature of allegation and the fact that the petitioner is a lady, I am inclined to allow this application. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender 2025:JHHC:17360 2 before the learned court below within four weeks from the date of receipt of copy of this order and on the event of her surrender or arrest, she shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Jamshedpur, in connection with Kawali P.S. Case No.44 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. The petitioner should cooperate with the investigation. 8. Interlocutory Application being I.A. No.5171 of 2025, stands dismissed as having been rendered infructuous, as the matter is taken up and decided today. (ANANDA SEN, J.) Prashant. Cp-3
