This is an application filed under Article 226 of the Constitution of India challenging the Order dated 07.01.2025, issued by the Deputy Commissioner, Papum Pare District, Yupia wherein it has been stated that the petitioner shall dismantle the structure and remove the debris within the wall of the project site for “Establishment of State Cancer Institute” at Midpu within 24 hrs from the date of issue of the order.
3. According to the learned counsel for the petitioner, the notice has not been properly issued, as it is the Estate Officer who is the authorised person to issue such notice in the matter. Therefore, the petitioner may be protected and stay the impugned order dated 07.01.2025, issued by the respondent No.4.
4. On the other hand, Mr. T. Tagum, learned Standing Counsel for the Health Department submits that the matter may be remanded back and
disposed of by setting aside the order dated 07.01.2025 passed by the Deputy Commissioner, Papum Pare District, with a direction to the Deputy Commissioner to take necessary steps, in accordance with law. Learned Government Advocate has also submitted in the same tune.
5. Considering the submissions made by the learned counsel for the parties, the matter is disposed of at motion stage, remitting the matter to the Deputy Commissioner, Papum Pare District, Yupia, with a direction to take necessary and appropriate steps, in accordance with law.
6. Accordingly, the order/notice dated 07.01.2025, issued by the

7. In view of the above, the present writ petition stands disposed of.
