An affidavit has been filed on behalf of the respondent-C.B.I. on 23.09.2025 stating therein that sole appellant Shanti Kumar Paul has expired on 09.10.2015 and it has been ascertained and confirmed that Shanti Kumar Paul and Santi Kumar Pal was the same person, who was working in B.C.C.L., Dhanbad. 3. A photocopy of certificate of death of Santi Kumar Pal has also been enclosed at page 6 of the said affidavit, whereas photocopy of death certificate of said Santi Kumar Pal issued by the Hospital of SAIL has been enclosed as Page 7 to the said affidavit. 4. It appears that the above affidavit has been filed through one Raghunath Kumar, son of Late Gaja Nand Kumar, working and posted as Inspector of Police, C.B.I., A.C.B., Dhanbad. 5. It has been stated in Para 3, 4 and 5 of the affidavit that in compliance of the order dated 25.08.2025 passed by this Court in Criminal Appeal (S.J.) No. 11 of 2007, one Biplab Pramanik, PC, CBI, Neutral Citation No. ( 2025:JHHC:31376 ) -2- ACB, Dhanbad was deputed to ascertain about the life status of the appellant and in this regard he submitted his self-explanatory report dated 12.09.2025, marked as Annexure-1 along with Two (02) enclosures, viz. (i) copy of Death Certificate of appellant Santi Kumar Pal, issued by Health Officer, Asansol Municipal Corporation, Asansol on 24.11.2015 and (ii) got issued copy of Death Certificate of Appellant dated 09.10.2015 issued by Burnpur Hospital, SAIL, Circular Road, Burnpur, West Bengal. It has also been ascertained and confirmed that Shanti Kumar Paul and Santi Kumar Pal are the same person, who was working in B.C.C.L., Dhanbad 6. Thus, in view of death of sole appellant Shanti Kumar Paul, the instant Criminal Appeal (S.J.) No. stands abated in the light of the provisions of Section 435 of B.N.S.S., 2023. 7.
