The case of the petitioner is that his entire holding measuring 4 bigha 11 biswa 11 biswansi of Plot No.188, Village- Chakki, Pargana, Kotia Gunir, Tehsil- Bindki, Fatehpur was acquired by the respondents under the Land Acquisition Act, 1894. The petitioner has been paid compensation only for 4 bigha whereas compensation for 11 biswa 11 biswansi has not been paid to him so far. 2. Shri Ishan Deo Giri, learned counsel appearing on behalf of respondent no.2, on instructions, states that award for the entire acquired land was duly made and the amount is in deposit with the Special Land Acquisition Officer. The petitioner sought a reference under Section 18 only in respect of 4 bigha and as per the award of reference court, the enhanced compensation for 4 bigha has already been paid. The compensation amount for the remaining land, being in deposit with the Special Land Acquisition Officer, it could be withdrawn by the petitioner by moving appropriate application. 3. Having regard to the said stand, we dispose of the instant petition with liberty to the petitioner to apply for release of compensation for the remaining land by moving appropriate application before the Special Land Acquisition Officer. It is further provided that, in the event, any such application is made by the petitioner before the Special Land Acquisition Officer, the Special Land Acquisition Officer will pass appropriate orders on the said application within six weeks.
