Order No.03 Dated- 07.11.2025
Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of W.P. (Cr.) No. 101 of 2025 to its original file.
Learned counsel for the petitioner submits that W.P. (Cr.) No. 101 of 2025 was dismissed for non-compliance of the peremptory order dated 17.02.2025. It is next submitted that due to inadvertence, the said peremptory order dated 17.02.2025 could not be complied with as the petitioner’s earlier Advocate has died due to cardiac arrest. It is further submitted that non-compliance of the peremptory order was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said W.P. (Cr.) No. 101 of 2025 and unless W.P. (Cr.) No. 101 of 2025 is restored to its original file, the
petitioner will be highly prejudiced. Hence, it is submitted W.P. (Cr.) No. 101 of 2025 be restored to its original file.
Considering the facts of the case and the submission of the
learned counsel for the petitioner, W.P. (Cr.) No. 101 of 2025 is restored to its original file to the stage at which, it was before its dismissal.
List W.P. (Cr.) No. 101 of 2025 under the appropriate heading before the appropriate bench after a week.
