Jogta, District Dhanbad, Jharkhand. … … Respondent(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Raj Nandan Chatterjee, Advocate For the Respondent(s) : Mr. Amit Kr. Sinha, Advocate ------ 04/ 24th November,2025 1. Heard the parties. 2. The husband of this petitioner was an employee of Bharat Coking Coal Limited. He died in harness on 24.04.1995. After the death of the husband of this petitioner, the petitioner nominated her brother-in-law (brother of the deceased workman) for compassionate appointment. The same was rejected by the BCCL holding that he is not the direct dependent of the deceased. The petitioner thereafter applied for compassionate appointment which was also rejected. The petitioner now claims that she is entitled for monetary benefit. The respondents had provided the necessary forms to the petitioner for claiming monetary benefits. 3. It is the case of the respondents that the petitioner has not filed-up the said forms to enable the respondents to process them for paying monetary compensation to the petitioner. 4. Considering the aforesaid fact, I direct the petitioner to 2025:JHHC:35002 2 fill-up the necessary forms which the respondents have provided to her to get the benefit of monetary compensation. Once the said forms are deposited by the petitioner to the respondents, the respondents will process the same and will ensure the payment of monetary benefits to the petitioner, if there is no other legal impediments. It is made clear that the monetary benefit should be paid from the date when the petitioner has nominated his brother- in-law for getting compassionate appointment, as the petitioner was entitled to receive monetary benefit from the said date when the first application for compassionate appointment was made by her on behalf of her brother-in-law who happens to be the brother of the deceased workman which ultimately got rejected. 5. The petitioner should fill-up the forms within a period of four weeks and the respondents are directed to process the same and arrived at a conclusion within four weeks thereafter. 6. With the aforesaid observation, this writ petition stands disposed of. (ANANDA SEN, J.) 24th November, 2025 Sandeep, cp2 Uploaded on 01/12/2025
