This petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.313/2025 of Suryanagar Police Station registered for the offences punishable under Sections 108, 115(1), 118(1), 84, 352, 351(3) of BNS, 2023. 2. Heard the learned counsel for the petitioner and the learned Additional State Public Prosecutor for the respondent - State. 3. The learned counsel for the petitioner would contend that, the petitioner is the mother-in-law of the deceased. There is no serious allegation against the

petitioner abetting the deceased to commit suicide. The allegation against the petitioner is that she was supporting her son, who is the husband of the deceased in spite of marrying another lady. She further submits that the statement given by the deceased in the hospital that there is no allegation against the petitioner, and the deceased had stated that, due to financial problem, she committed suicide. She further submits that, the petitioner is ready to cooperate with the police in the investigation, and abide by any conditions that may be imposed by this Court. With this, she prayed to allow the petition. 4. Per contra, the learned Additional State Public Prosecutor for the respondent - State would contend that, the case is under investigation. The petitioner stated to have supported her son - accused No.1 even after he marrrying another lady during lifetime of his wife. The petitioner has not appeared before the Investigating Officer for investigation. With this, she prayed for dismissal of the petition. - 4 -

5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record. 6. The deceased was the wife of the accused No.1, who is the son of the petitioner/accused No.2. In the FIR, there is an allegation that the accused No.1 demanded additional dowry along with his mother. The accused No.1 had illicit relationship with the lady, and subsequently married her by tying thali, and the petitioner has got removed the said thali, and put it in a hundi of the temple, and asked her son not to contact with the said lady, in spite of that, he continued to contact with the said lady.
The allegation against the petitioner is that when the deceased intimated the same to the petitioner, she did not support her and abused her. Whether the act of petitioner amounts to abetting to commit suicide is the matter of investigation and trial. The petitioner has undertaken to cooperate with the police in the investigation, and abide by the terms and

conditions to be imposed by this Court. The petitioner has made out a case for grant of anticipatory bail with the conditions:
In the result, the following:
ORDER
i) The petition is allowed.
ii) The petitioner is ordered to be released in the event of her arrest in Crime No.313/2025 of Suryanagar Police Station subject to the following conditions:
a) The petitioner shall execute a personal bond for a sum of Rs.One lakh with one surety for the likesum to the satisfaction of the Investigating Officer;
b) The petitioner shall appear before the Investigating Officer within fifteen days from this day and execute bail bond and furnish surety;
c) The petitioner shall cooperate with the police in the investigation;

d) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.
